Opinion

No. 05-10-00928-CV

Opinion issued January 14, 2011.

Original Proceeding from the 254th Judicial District Court, Dallas County, Texas, Trial Court Cause Nos. DF 04-17651-S.

Before Justices O'NEILL, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relators contend the trial court erred in issuing a capias. The facts and issues are well known to the parties, so we need not recount them herein. The order for capias and writ of capias has been vacated and withdrawn by the trial court. Therefore, we conclude the issues presented in this petition are moot. See In re Gill, No. 06-04-00090-CV, 2004 WL 1884498 at *1 (Tex. App.-Texarkana Aug. 24, 2004, orig. proceeding). Accordingly, we DISMISS relators' petition for writ of mandamus and LIFT the stay imposed by our order of July 29, 2010.
