Opinion

No. 04-03-00230-CV.

Delivered and Filed: April 2, 2003.

Original Mandamus Proceeding, Arising from the 81st Judicial District Court, Karnes County, Texas, Trial Court No. 02-08-00120-CRK, Honorable Olin B. Strauss, Judge Presiding.

PETITION FOR WRIT OF MANDAMUS DENIED.

Sitting: Paul W. GREEN, Justice, Sarah B. DUNCAN, Justice, Karen ANGELINI, Justice.

MEMORANDUM OPINION

Relator, Curtis Williams, filed a pro se petition for mandamus relief seeking an order for the trial court to set a hearing on the State's motion for revocation or to set bail. Williams' remedy for the trial court's failure to rule on the revocation or to release him is an application for habeas corpus. Roberts v. State, 627 S.W.2d 183, 184-85 (Tex. Crim App. 1982); Aguilar v. State, 621 S.W.2d 781, 785-86 (Tex.Crim.App. 1981).

Because Williams is not entitled to mandamus relief, we deny his petition.
