Opinion

1639

September 26, 2002.

Order of disposition, Family Court, Bronx County (Harold Lynch, J.), entered on or about October 31, 2001, which adjudicated appellant a juvenile delinquent upon a fact-finding determination that he committed an act that, if committed by an adult, would have constituted menacing in the third degree, and placed him in the custody of the New York State Office of Children and Family Services for a period of up to 12 months, unanimously affirmed, without costs.

DODD R. TERRY, for appellant.

MARTA ROSS, for PRESENTMENT AGENCY.

Before: Mazzarelli, J.P., Andrias, Buckley, Sullivan, Lerner, JJ.

The record establishes that the court's placement of appellant was the least restrictive alternative consistent with his needs and the needs of the community (see Matter of Katherine W., 62 N.Y.2d 947), in view of appellant's serious behavioral problems at home and in school. The court properly relied upon professional evaluations by a psychologist and a probation officer as to appellant's need for placement.

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
