IN RE ROBERT B. WILCOX

Original Proceeding
172nd District Court of Jefferson County, Texas
Trial Cause No. E-205,503

ORDER

Robert B. Wilcox, Relator, filed a petition for a writ of mandamus and a motion for temporary relief. See Tex. R. App. P. 52. Relator is the defendant in Trial Cause Number E-205,503, Southeast Texas Veterinary Clinics PLLC, v. Robert B. Wilcox, DVM et al. Relator seeks a writ compelling the Honorable Mitch Templeton, Judge of the172nd District Court of Jefferson County, Texas, to vacate a September 3, 2020 order and a November 16, 2020 amended order appointing an e-discovery specialist and granting a motion to compel production of electronically stored information. See Tex. Gov't Code Ann. § 22.221.

Relator requests that the trial court's orders be stayed while this Court considers the mandamus petition. The Court finds temporary relief is necessary to prevent undue prejudice. It is ORDERED that the trial court's September 3 and November 16, 2020 discovery orders are STAYED until our opinion issues or until further order of this Court. See Tex. R. App. P. 52.10(b). No bond is required of Relator as a condition to any relief herein granted.

The Response of the real party in interest, Southeast Texas Veterinary Clinics PLLC, to the petition for a writ of mandamus is due December 4, 2020.

MOTION FOR TEMPORARY RELIEF GRANTED.

ORDER ENTERED November 24, 2020.

PER CURIAM Before McKeithen, C.J., Horton and Johnson, JJ.
