COA: 235731, Macomb CC: 92-036958-NA

On order of the Court, the application for leave to appeal from the November 1, 2002 decision of the Court of Appeals is considered, and it is GRANTED, limited to the issue whether a putative biological father has standing to intervene in a Juvenile Code child protective proceeding where the subject child already has a legal father. The Children's Law Section of the State Bar is invited to file a brief as amicus curiae. Other persons or groups interested in the determination of the question presented in this case, and its ramifications, may move the Court for permission to file briefs amicus curiae.

The case will be argued during the March 2003 session of this Court. Appellant's brief and appendix, shall be filed no later than February 7, 2003, and appellee's brief and appendix, if any, shall be filed no later than March 3, 2003.

We further ORDER that further proceedings in the Family Division of the Macomb Circuit Court be stayed, except that, on motion of a party or on its own motion, the Family Division of the Macomb Circuit Court may act to protect the safety of the child or conduct proceedings required by law.
