Before the Court is appellant's October 5, 2023 amended motion to extend time to file his brief. We note the deadline for filing the appellate record was suspended pending the Court's determination of its jurisdiction over the appeal, and the deadline to file an appellant's brief is not triggered until the record is filed. See TEX. R. APP. P. 38.6(a). Accordingly, we DENY the motion as premature.

The Court will set a deadline for the filing of appellant's brief if it determines it has jurisdiction over the appeal.
