ORDER


The Court has received applications from United Parcel Service ("UPS"), Lowe's Companies, Inc. ("Lowe's"), and Toys "R" Us, Inc. ("Toys "R" Us"), requesting access to the sealed summary judgment papers in this action and additional time to determine whether or not to opt-out of the class.

In an order issued on November 7, 2002, this Court granted in part two similar requests, giving those applicants until November 27, 2002, to opt out of the class. The Court hereby grants the same extension to UPS, Lowe's, and Toys "R" Us, and to any other class member who notifies the Court, in writing, by November 14, 2002 (the original opt-out deadline), that that class member desires the same extension.

The order was incorrectly dated August 6, 2002.

Redacted copies of the previously sealed court records have now been delivered to the Court and will shortly be made part of the public court file. However, inasmuch as only one set of those records will be available for inspection in the Clerk's Office, and in light of the high demand for access to those records, persons wishing to review the parties' summary judgment papers may prefer to visit the class notice administrator's web site for this case; according to the parties, the summary judgment papers will be posted to that web site by the close of business today.

SO ORDERED.
