DECISION & ORDER ON MOTION

Motion by Stella Isaza, the court-appointed inventory attorney with respect to the above-entitled matter, to be discharged as inventory attorney for the legal files of Michael R. Varble, who was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on January 13, 1997, and to authorize the destruction, by shredding, of unclaimed files. By opinion and order of this Court dated February 27, 2019, Mr. Varble was disbarred, effective immediately, upon his resignation (see Matter of Varble, 170 A.D.3d 41).

By decision and order on motion dated July 17, 2019, Rebecca Mayfield Blahut, was appointed inventory attorney. By decision and order on motion dated August 29, 2019, Blahut was relieved as inventory attorney and Stella Isaza was appointed as inventory attorney.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further, ORDERED that Stella Isaza is authorized to arrange for the destruction, by shredding, any unclaimed files contemplated by the court-ordered inventory that have been earmarked for destruction under the guidance of Muriel L. Gennosa, Executive Director for Attorney Matters; and it is further, ORDERED that Stella Isaza shall turn over to the Grievance Committee for the Ninth Judicial District a record of all files inventoried, and shall advise whether those files were delivered to clients or their counsel, or remained unclaimed and were destroyed pursuant to this order; and it is further, ORDERED that Stella Isaza shall turn over to the Grievance Committee for the Ninth Judicial District any and all bank and bookkeeping records of Michael R. Varble for safekeeping in accordance with rule 1.15(d) of the Rules of Professional Conduct (22 NYCRR 1200.0); and it is further, ORDERED that upon completion of the foregoing, Stella Isaza is discharged as court-ordered inventory attorney in the above-captioned matter.
