ORDER DENYING, WITHOUT PREJUDICE, THE FIRST APPLICATION OF SPECIAL COUNSEL MORGAN ASSOCIATES, PLC FOR AWARD OF FEES AND REIMBURSEMENT OF EXPENSES AS ATTORNEYS FOR DEBTOR-IN-POSSESSION


This case is before the Court on the "First Application Of Special Counsel Morgan Associates PLC For Award Of Fees And Reimbursement Of Expenses As Attorneys For Debtor-In-Possession," filed on February 16, 2007 (Docket # 59), seeking interim fees and reimbursement of expenses. The Applicant filed a Certification of No Response on March 23, 2007.

The Court cannot approve the fee application at this time because the "Order Establishing Deadline and Procedures," filed on November 29, 2006 (Docket # 26), prohibits the filing of interim fee applications. It provides, in relevant part: "Unless the Court orders otherwise, each professional shall file one and only one final fee application." ( See "Order Establishing Deadline and Procedures" at 3 ¶ 7.)

Accordingly,

IT IS ORDERED that the "First Application Of Special Counsel Morgan Associates PLC For Award Of Fees And Reimbursement Of Expenses As Attorneys For Debtor-In-Possession," filed on February 16, 2007 (Docket # 59), is DENIED without prejudice.
