In the MATTER OF Irvin TOBIN, An Attorney At Law (Attorney No. 179581957)
ORDER The Disciplinary Review Board having filed with the Court its decision in DRB 20-213, concluding on the record pursuant to Rule 1:20-4(f)(default by respondent), that Irvin Tobin of Hillside, who was admitted to the bar of this State in 1957, should be censured for violating RPC 1.15(d) (failure to comply with the recordkeeping provisions of Rule 1:21-6) and RPC 8.1(b) (failure to cooperate with disciplinary authorities);
And the Disciplinary Review Board having further concluded that respondent should be required identify and disburse all client trust funds in his trust account within six months of the date of the Court's Order and promptly deposit any funds not disbursed with the Superior Court Trust Fund;
And the Board also having determined that respondent should be required to cooperate with the Office of Attorney Ethics in connection with an audit of his attorney accounts;
And good cause appearing;
It is ORDERED that Irvin Tobin is hereby censured; and it is further
ORDERED that Irving Tobin shall identify and disburse to the appropriate parties all client trust funds in his attorney trust account within six months after the file date of this Order and deposit any funds that cannot be identified or disbursed into the Superior Court Trust Fund; and it is further ORDERED that Irving Tobin shall cooperate with the Office of Attorney Ethics in connection with any audit it conducts of his attorney accounts; and it is further
ORDERED that the entire record of this matter be made a permanent part of respondent's file as an attorney at law of this State; and it is further
ORDERED that respondent reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of this matter, as provided in Rule 1:20-17.
