In re Tara Marie Thomas

257th District Court of Harris County Trial court case number: 2016-88084

ORDER

April Farris, Judge

On February 15, 2023, relator, Tara Marie Thomas filed a petition for a writ of mandamus challenging the trial court's August 12, 2022 "Order Enforcing Child Support Order with Commitment Suspended." On March 14, 2023, the Court denied relator's petition for writ of mandamus. Accordingly, any motion for rehearing was due no later than March 29, 2023. See Tex. R. App. P. 49.1 (motion for rehearing due within 15 days of court of appeals' judgment or order).

On March 28, 2023, relator filed a "Motion to Extend Time to File Motion for Reconsideration," requesting that the deadline to file a motion for rehearing be extended to April 27, 2023. See Tex. R. App. P. 49.8 ("A court of appeals may extend the time for filing a motion for rehearing . . . if a party files a motion complying with Rule 10.5(b) no later than 15 days after the last date for filing the motion."). Counsel for relator states that the extension is necessary because his "other professional obligations have required and will require a significant commitment of time," preventing him from filing a motion for rehearing in this original proceeding.

Relator's motion to extend the deadline for filing a motion for rehearing is granted in part. The deadline for filing a motion for rehearing is extended to April 13, 2023.

It is so ORDERED.
