MEMORANDUM OPINION


Relator contends the trial court abused its discretion by failing to promptly rule on relator's appeal of the associate judge's report and recommendation. Based on the record presented, we conclude the relator has failed to show the trial court abused its discretion. See Walker v. Packer, 827 S.W.2d 833, 839-40 (Tex. 1992) (orig. proceeding). Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a).

The real party in interest's motion to dismiss and for sanctions is DENIED.
