MEMORANDUM OPINION


On October 30, 2008, Leslie Garnett filed a pro se notice of appeal attempting to perfect an appeal from the "order and judgment" of the trial court. We dismiss the appeal for want of jurisdiction.

On December 19, 2008, the clerk's record was filed in this court. On January 8, 2009, a supplemental clerk's record was filed in this court. The supplemental clerk's record contains Garnett's notice of past-due findings of fact and conclusions of law, Garnett's request for designation of record, and the clerk of the trial court's written response to Garnett's request for designation of record.

On December 23, 2008, the clerk of this court wrote the parties advising them that we were unable to locate a final, appealable order or judgment in the clerk's record. Garnett was directed to respond in writing on or before January 7, 2009, showing grounds for continuing the appeal. As of this date, there has been no response to our December 23 letter. The appeal is dismissed.
