IN RE THE TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES,

Original Mandamus Proceeding

This proceeding arises out of Cause No. 2018PA00915, styled In the Interest of P.K., a Child, pending in the 408th Judicial District Court, Bexar County, Texas, the Honorable Mary Lou Alvarez presiding.

Sitting: Rebeca C. Martinez, Chief Justice Irene Rios, Justice Lori I. Valenzuela, Justice

ORDER

PER CURIAM

On June 3, 2022, relator filed a petition for writ of mandamus and a motion for stay. This court granted the stay and ordered respondent and real parties in interest may file responses on or before June 22, 2022. Given the time restraints, relator represented it would file a signed copy of the June 1, 2022 order and a transcript of the June 1, 2022 hearing once received. Relator did not file either the order or the transcript.

On June 24, 2022, we ordered relator to file a signed copy of the June 1, 2022 order and a transcript of the June 1, 2022 hearing on or before June 29, 2022. Relator has not filed either the order or the transcript.

We ORDER relator to file, on or before July 11, 2022, a signed copy of the June 1, 2022 order and a transcript of the June 1, 2022 hearing. If relator fails to file a signed copy of the June 1, 2022 order and a transcript of the June 1, 2022 hearing for a second time, this matter may be denied without prejudice. See In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 138 (Tex. 2004) (orig. proceeding). If relator has not obtained a signed copy of the June 1, 2022 order and a transcript of the June 1, 2022 hearing, relator must file an advisory to this court detailing the reasons for failing to obtain the signed order and transcript.

We further ORDER relator to file an advisory to this court regarding the placement status of P.K. on or before July 11, 2022.

If relator fails to comply with this order, this proceeding will be dismissed. See TEX. R. APP. P. 42.3(b), (c).

It is so ORDERED.
