No. 05-07-00197-CV (Tex. App. Mar. 22, 2007)

Opinion

No. 05-07-00197-CV

Opinion issued March 22, 2007.

Original Proceeding from the 160th Judicial District Court Dallas County, Texas, Trial Court Cause No. 06-04868-H.

Before Justices MOSELEY, BRIDGES, and FRANCIS.

MEMORANDUM OPINION

Relator contends the trial court erred in denying defendant's amended and supplemental motion to cancel lis pendens. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has failed to show the trial court clearly abused its discretion. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus. See Tex. R. App. P. 52.3.
