Renewed motion by Daniel D. Tartaglia for reinstatement to the bar as an attorney and counselor-at-law. Mr. Tartaglia was admitted to the bar at a term of the Supreme Court of the Appellate Division in the Second Judicial Department on July 29, 1981, under the name Daniel David Tartaglia. By decision and order on motion dated April 15, 2008, as amended by decision and order on motion dated May 2, 2008, this Court, on its own motion, suspended Mr. Tartaglia as a result of his conviction of a serious crime, pursuant to Judiciary Law § 90 (4) (f), authorized the Grievance Committee for the Ninth Judicial District to institute and prosecute a disciplinary proceeding against him, and referred the issues raised to the Honorable William D. Friedmann, as Special Referee to hear and report. By opinion and order of this Court dated July 14, 2Q09, Mr. Tartaglia was suspended from the practice of law for a period of one year, with credit for the time elapsed under his interim suspension, and was granted leave to apply for reinstatement immediately. By decision and order on motion of this Court dated November 5, 2009, Mr. Tartaglia's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on his fitness to be an attorney including, but not limited to, a review of his 2008 tax return. By decision and order on motion of this Court dated October 1, 2010, the respondent's motion for reinstatement was denied with leave to renew upon presentation of his tax returns.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

Ordered that the motion is granted; and it is further,

Ordered that, effective immediately, the respondent, Daniel D. Tartaglia, admitted as Daniel David Tartaglia, is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Daniel David Tartaglia to the roll of attorneys and counselors-at-law.
