MEMORANDUM OPINION

BONNIE LEE GOLDSTEIN JUSTICE

Appellant's brief in this case is overdue. By order dated August 21, 2023, we struck appellant's brief because it did not comply with rules 9 and 38.1 of the Texas Rules of Procedure. In that order we directed appellant to file a brief in compliance with the rules of appellate procedure within ten days. We cautioned appellant that failure to do so would result in the dismissal of this appeal without further notice. See TEX. R. APP. P. 38.8(a)(1).

By order dated September 21, 2023, we extended the time for appellant to file his brief and sent appellant a copy of the clerk's record as well as a copy of rules 9.9 and 38.1 of the rules of appellate procedure. We ordered appellant to file his brief by November 3, 2023. To date, appellant has not filed his brief or further corresponded with the Court regarding the status of this appeal.

Accordingly, we dismiss this appeal. See TEX. R. APP. P. 38.8 (a)(1); 42.3(b), (c).

JUDGMENT

In accordance with this Court's opinion of this date, this appeal is DISMISSED.
