IN RE DOROTHY M. GREEN SUMAN, Relator

ORIGINAL PROCEEDING WRIT OF MANDAMUS
Probate Court No. 3 Harris County, Texas
Trial Court Cause No. 481,235

MEMORANDUM OPINION

Relator Dorothy M. Green Suman has petitioned for a writ of mandamus contending the Honorable Jason Cox, the presiding judgment of Probate Court No. 3 of Harris County, abused his discretion in denying her motion for summary judgment in the underlying will contest proceeding.

In general, mandamus review is not available from the denial of summary judgment, no matter how meritorious the motion. In re McAllen Med. Ctr., Inc., 275 S.W.3d 458, 465-66 (Tex. 2008) (orig. proceeding).. An exception exists when denial of summary judgment might result in multiple trials. In re United Servs. Auto. Ass'n, 307 S.W.3d 299, 314 (Tex. 2010) (orig. proceeding).

Relator cites In re United Services Automobile Ass'n and asserts this case "presents extraordinary circumstances for the issuance of a writ where summary judgment has been denied." She does not identify those extraordinary circumstances or explain why they would justify mandamus review in this case.

Relator has not shown she is entitled to mandamus relief. We deny her petition for writ of mandamus.

PER CURIAM Panel consists of Chief Justice Frost and Justices Zimmerer and Poissant.
