IN RE STATE OF LA v. MARK MILLER IN RE MARK MILLER

APPLYING FOR SUPERVISORY WRIT FROM THE TWENTY-THIRD JUDICIAL DISTRICT COURT, PARISH OF ST JAMES, STATE OF LOUISIANA, DIRECTED TO THE HONORABLE JASON VERDIGETS, DIVISION "A", NUMBER 10, 6011

Panel composed of Judges Susan M. Chehardy, Fredericka Homberg Wicker, and Jude G. Gravois

WRIT OF MANDAMUS GRANTED

Relator, Mark Miller, seeks a writ of mandamus from this Court, ordering the 23rd Judicial District Court, Parish of St. James, to rule on a "Motion to Compel/to Correct Illegal Sentence" that he filed in Case No. 10-F-006011, Division "A", on or about April 21, 2021. This Court's review of the official record indicates that relator's motion was filed on April 23, 2021, but the official record evidences no ruling upon the motion at this time. Accordingly, the writ of mandamus is granted. The trial court is hereby ordered to rule upon relator's "Motion to Compel/to Correct Illegal Sentence" filed on or about April 23, 2021 within 30 days of the date of this disposition, if it has not already done so, and to furnish a copy of said ruling to relator and to this Court within 10 days of the date of such ruling.
