Opinion

No. 05-04-00317-CV.

Opinion Issued March 22, 2004.

Original Proceeding from the Probate Court No. 1, Dallas County, Texas, Trial Court Cause No. 03-2772-P(a).

Writ of Mandamus Denied.

Before Chief Justice THOMAS and Justices WHITTINGTON and O'NEILL.

MEMORANDUM OPINION

Relator contends the trial judge erred in ordering a response to a subpoena. The facts of this original proceeding are known to the parties so we do not recite them here. The merits cannot be ascertained because the record supplied does not include the motions or orders at issue. Even assuming the trial court ordered a response to the subpoena, the relator has not shown the trial judge clearly abused her discretion in ordering the response. Accordingly, relator's petition for writ of mandamus is DENIED. See § 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
