No. 08-12-00308-CV (Tex. App. Jan. 14, 2014)

Opinion

No. 08-12-00308-CV

IN RE: GABE SASSIN, Relator.

AN ORIGINAL PROCEEDING

IN MANDAMUS

ORDER

Before the Court is the Relator's petition for writ of mandamus, claiming the trial court has abused her discretion by denying Relator's motion to quash plaintiff's notice of deposition and motion for protective order. We note that Relator's petition lacks the certification mandated by the Texas Rules of Appellate Procedure 52.3(j). The relator "must certify that ... every factual statement in the petition is supported by competent evidence included in the appendix or the record." TEX.R.APP.P. 52.3(j); see also In re Butler, 270 S.W.3d 757 (Tex.App.-Dallas 2008, orig. proceeding); In re Vasquez, No. 08-12-00267-CV, 2012 WL 4714492 (Tex.App.--El Paso Oct. 3, 2012, orig. proceeding) (not designated for publication); In re Sweed, No. 08-04-00128-CV, 2004 WL 1427375, at *1 (Tex.App.--El Paso June 24, 2004, orig. proceeding) (not designated for publication).

Accordingly, Relator is directed to file an amended certification in compliance with Rule 52.3(j) within ten (10) days of the issuance of this order.

PER CURIAM

Before McClure, C.J., Rivera and Rodriguez, JJ.
