ORDER

On October 20, 2023, relators S.A.R.S. Trucking Ltd. and Felipe Rodriguez filed a petition for a writ of mandamus. In their mandamus petition, relators contend that the trial court abused its discretion by denying their "Motion for Leave to Late Designate Experts." Relators' mandamus petition states that they requested "leave to designate a defense medical expert to respond to [the] amended disclosures (a year after [r]elators' expert designation deadline)" of real party in interest Janelle Solis. In her amended disclosures, real party in interest increased the amount of economic damages she seeks in the underlying lawsuit "by $434,000" because she "decided to have a lumbar fusion."

Relators request that the Court issue a writ of mandamus and "set[] aside [the trial court's] denial of [relators'] Motion for Leave to Late Designate an expert witness to address the need for and cost and effects of future lumbar spine surgery" for real party in interest.

We request a response to the petition for writ of mandamus from the real party in interest, Janelle Solis. The response, if any, is due to be filed with this Court no later than twenty days following the date of this order.

It is so ORDERED.
