On April 18, 2016, the relator, Abelardo Santos, filed a petition for writ of mandamus seeking to compel the respondent trial judge to rescind his February 12, 2016 "Declaration Regarding 'Default Judgment' Signed and Entered on April 14, 2015," which purported to find and declare that the default judgment signed on April 14, 2015, was not a final and appealable judgment, but was instead interlocutory. No response has been filed by the real party in interest.
The Court requests a response to the mandamus petition by the real party in interest, Remedial Construction Services, L.P. See TEX. R. APP. P. 52.8(b)(1). The response, if any, shall be filed within 30 days from the date of this order. See id. 2, 52.4.
