Opinion

          In banc. Appeal from superior court. city and county of San Francisco; J. V. Coffey, Judge. In the matter of the estate of Josephine L. Sanford, deceased. From an order denying the motion of Charles E. Sanford to vacate the decree of distribution and for a new trial on petition for final distribution, he appeals. Dismissed.

          OPINION

          PER CURIAM.

         This is an appeal by Charles E. Sanford from an order made by the superior court on May 6, 1901, ‘denying his motion to vacate the decree of distribution herein and to grant a new trial upon the petition for final distribution herein.’ As the merits of the case were fully disposed of in favor of the appellant by the judgment of this court on his appeal from the decree of distribution (68 P. 494), this present appeal from said order of May 6, 1901, is hereby dismissed. Let the remittitur issue forthwith.
