Opinion

No. 05-08-01596-CV

Opinion issued December 12, 2008.

Original Proceeding from the 330th Judicial District Court Dallas County, Texas, Trial Court Cause No. 06-09375.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the Dallas County District Clerk has violated a ministerial duty by refusing to forward relator's notice of appeal to this Court. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). Accordingly, we DENY relator's petition for writ of mandamus.
