IN RE SAFECO INSURANCE COMPANY OF INDIANA
Original Mandamus Proceeding Before Morriss, C.J., Burgess and Stevens, JJ. ORDER
On March 31, 2021, Safeco Insurance Company of Indiana (Safeco), Relator, filed a petition for writ of mandamus, seeking an order from this Court requiring the trial court to withdraw its March 1, 2021, order granting Donna Gail Hamlin's Motion to Compel Deposition of Defendant's Corporate Representative and Motion for Attorney's Fees. Also, on March 31, 2021, Safeco filed a motion for temporary relief requesting that this Court enter a partial stay of the underlying proceedings by (1) prohibiting the trial court from enforcing its March 1, 2021, order and (2) abating all proceeding related to compelling Safeco's corporate representative's deposition, including the hearing on Plaintiff's Second Motion for Sanctions scheduled for April 1, 2021, pending this Court's ruling on Safeco's petition for writ of mandamus.
After reviewing the petition for writ of mandamus and the motion for temporary relief, this Court is of the opinion that the relief requested in the motion for temporary relief should be granted.
Accordingly, it is ordered that the hearing currently scheduled for April 1, 2021, is stayed pending this Court's decision on Safeco's petition for writ of mandamus. See TEX. R. APP. P. 52.10. In addition, it is also ordered that the trial court's March 1 order requiring the deposition of Safeco's corporate representative, and the payment of $1,500.00 to Hamlin for costs, is stayed pending this Court's decision on Safeco's petition for writ of mandamus.
