ORDER

Before the Court is appellee's August 17, 2017 motion to disqualify Quilling, Selander, Lownds, Winslett & Moser, P.C. and to abate the pending appeal. In his motion, appellee states that the former trial court judge of the 254th Judicial Court, who presided over a portion of this case, has become a partner in the law firm of Quilling, Selander, Lownds, Winslett & Moser, P.C. which represents appellant. We GRANT appellee's motion to the following extent.

We ORDER the trial court to make findings of fact consistent with Texas Disciplinary Rules of Professional Conduct 1.10 and 1.11 regarding whether the law firm of Quilling, Selander, Lownds, Winslett & Moser, P.C. should be disqualified from representing appellant in this case. See TEX. DISCIPLINARY RULES PROF'L CONDUCT R. 1.10, 1.11, reprinted in Tex. Gov't Code Ann., tit. 2, subtit. G, app. A (West 2013) (Tex. State Bar R. art. X, § 9).

We ORDER the trial court to transmit to the Court, within THIRTY DAYS of the date of this order, a supplemental clerk's record containing the trial court's findings.

We ABATE the appeal to allow the trial court to comply with this order. We will reinstate the appeal when the supplemental record is received.
