No. 05-04-00191-CV.

Opinion issued March 10, 2004.

Original Proceeding from the 14th Judicial District Court Dallas County, Texas, Trial Court Cause No. 02-11425-A.

Writ of Mandamus Denied.

Before Chief Justice THOMAS, Justices MORRIS and FITZGERALD.

MEMORANDUM OPINION

Relator contends the trial judge erred in disqualifying his attorney Jeffrey W. Hellberg, Jr. The facts of this original proceeding are known to the parties so we do not recite them here. Based on the record presented, we conclude relator has failed to show he is entitled to the relief requested. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a). The Court VACATES its stay order issued February 18, 2004.
