Appeal from the 409th District Court of El Paso County, Texas (TC# 20200D02631)

Before Rodriguez, C.J., Palafox, and Alley, JJ.

MEMORANDUM OPINION

YVONNE T. RODRIGUEZ, Chief Justice

Relator, Yvonne Rosales, District Attorney, filed a petition for writ of mandamus, complaining of the 409th District Court for El Paso County's "Order Restraining Parties from Making Extrajudicial Statements" of July 1, 2022. Relator also filed two emergency motions seeking a stay of the trial court proceedings below. Both motions to stay were denied.

On December 2, 2022, Relator filed an unopposed motion to dismiss the Mandamus, stating there has been a change in circumstances and wishes to nonsuit the matter. See TEX.R.APP.P. 42.1(a)(1).

Accordingly, we grant the motion and dismiss the petition for writ of mandamus. 1
