CALOGERO, C.J. dissents.

LEMMON, J. dissents.

JOHNSON, J. dissents and would grant with the following order.

VICTORY, J. not on panel.

I would grant applicant's petition allowing him to take the bar exam this month. If he passes the exam, I would order him to file a brief with this Court explaining the circumstances regarding the judgment against him.

Although he did not apply timely, I would allow the applicant to take the February bar examination, based on his mistaken reliance on the continuing validity of his previous application. I would defer any determinations about his character and fitness until after he passes the examination.

Petitioner is allowed to take the Louisiana State Bar Examination in February, 1999. Within fifteen days of notification that he has satisfactorily passed this exam, petitioner may file a brief with this court explaining the details of the judgment against him.
