IT IS HEREBY STIPULATED AND AGREED THAT:

1. All claims by plaintiff Wanda Parks are dismissed with prejudice as to all defendants in this action.

2. A Motion for Summary Judgment was filed 07/30/04 ( docket item nos 2323-2324 on Master Rezulin docket, 00cv2843). When approved, this Stipulation of Dismissal will moot this motion only as it relates to this case and will close this case in its entirety.

3. Each party shall bear its own costs and attorneys' fees.
