STIPULATION AND ORDER OF PARTIAL DISMISSAL WITHOUT PREJUDICE


IT IS HEREBY STIPULATED AND AGREED THAT:

1. All claims by plaintiffs Evelyn Adams, Monzolia T. Course, Ann Dillard, Dora Fitzgerald, James H. Priscock, Emily Richards, Mary Ailene Westbrook and Annie B. White are dismissed without prejudice as to all defendants in this action.

2. A Motion to Dismiss filed by defendant Jerrold Olefsky is pending ( see Docket Item Nos. 2434 and 2435 in the Rezulin Master File, 00cv2843). When approved, this Stipulation of Dismissal will moot this motion only as it relates to the plaintiffs identified above.

3. When approved, this Stipulation of Dismissal will not close this case in its entirety.

4. Each party shall bear its own costs and attorneys' fees.
SO ORDERED.
