PRETRIAL ORDER NO. 401 (Stay Requests Pending Finalization of Settlements)


The Court has been advised that the Warner-Lambert defendants have reached an agreement in principle with Herman, Mathis, Casey, Kitchens Gerel, LLP; The Mathis Law Firm, P.C.; Herman, Herman, Katz Cotlar, L.L.P.; Levin, Fishbein, Sedrah Berman; and Taylor, Martino Kuykendall (collectively, "Negotiating Counsel"), on a mechanism for potentially resolving most of the remaining Rezulin claims pending in this Court and elsewhere. To allow sufficient time for other plaintiffs' counsel who intend to be bound by the terms of the settlement agreement to communicate with their clients regarding the settlement program, Negotiating Counsel and counsel for the Warner-Lambert defendants have moved jointly for an order that will govern requests for stays in this litigation, pending finalization of the settlement. As used herein, "Agreeing Counsel" shall mean plaintiffs' counsel other than Negotiating Counsel who agree to be bound by the proposed settlement.

The Court finds it is in the interest of justice and judicial economy to have an orderly process in place to govern the granting of stay requests made pursuant to the confidential settlement agreement. Accordingly, it is hereby ORDERED that:

1. All proceedings are hereby stayed in all Rezulin cases pending in this Court in which the plaintiffs are represented by Negotiating Counsel. All such cases are listed in Exhibit A.

2. Counsel for the Warner-Lambert defendants have agreed periodically to notify Charles A. Mathis, Jr. (or his designee) and the Clerk of this Court when they learn of new Agreeing Counsel. All proceedings will be stayed in all Rezulin cases pending in this Court in which the plaintiffs are represented by one or more Agreeing Counsel. The first list of cases represented by Agreeing Counsel is in Exhibit B.

3. Upon receipt of this Order, and upon receipt of any notice of additional Agreeing Counsel provided by counsel for defendants, the Clerk shall place in the docket of each identified individual case ( i.e., each case in which plaintiffs are represented by Negotiating Counsel or Agreeing Counsel) a copy of this Order, which shall signify that all such proceedings in that case have been stayed until further Order of the Court. The Clerk shall do so forthwith with respect to all cases listed in Exhibits A and B to this Order.
