PRETRIAL ORDER NO. 388 (Motion to Withdraw Motion to Withdraw)


PTO 387 granted the motion of Ken R. Adcock, Esq., to withdraw as counsel for the plaintiffs and dismissed these actions for lack of prosecution subject to the right of any plaintiff, by filing on or before August 12, 2005, of a notice of appearance by counsel or other appropriate indication of a desire to prosecute these actions, to reinstate his or her case. The Court subsequently received a motion from Mr. Adcock seeking to withdraw the motion resolved by PTO 387 solely insofar as it relates to plaintiff Peggy Crutchfield on the ground that she subsequently has been in touch with him.

Accordingly, PTO 387 is vacated insofar, and only insofar, as it dismissed the claims of Peggy Crutchfield and relieved Mr. Adcock as her counsel.

SO ORDERED.
