STIPULATION AND ORDER OF PARTIAL DISMISSAL WITH PREJUDICE


IT IS HEREBY STIPULATED AND AGREED THAT:

1. All claims by plaintiff Howard Sontag are dismissed with prejudice as to all defendants in this action.

2. A Motion for Judgment on the Pleadings was filed 01/25/05 ( see docket item nos. 2798 and 2799 on the Master Rez Docket, 00cv2843). When approved, this Stipulation of Dismissal will moot that motion as it relates to plaintiff Howard Sontag, however the motion will remain pending as to all other plaintiffs identified therein. When approved, this Stipulation of Dismissal will not close this case in its entirety.

3. Each party shall bear its own costs and attorneys' fees.
SO ORDERED.
