For Preservation purposes and in relation to Fed. Rules of Criminal Procedure 12(f) I Ask that the Court except these Issues as a letter in lieu of Motion.

The Defendant Respectfully ask that the court attach to defendants recent letter brief dated, Jan. 15, 2005.

Newly Discovered Evidence

Defendant Request a hearing on prosecution witnesses "Nelson Hill" "Alfred Murray" and Darryl James' committing perjury concerning events of the shooting death of Leon France "Aka Boogie" and also the assault on Alfred Murray "Aka Storm". (Direction of bullet hole in white van would have required the shooter to be on the opposite side of van). All prosecutions witness testified to defendant Dein. At the top of the corner.

Defendant request a hearing on perjured testimony given by Amin Ross and Elizabeth Taylor regarding Defendants responsibility with regards to drug amount, sold, possessed and distributed. Prosecution allowed witnesses testimony to go incorrected when questioned about the amounts of Crack Cocaine Packing per pack.

Denied.
