Opinion issued January 5, 2007.

Writ of Mandamus Dismissed

Before Justices Whittington, FitzGerald, and Lang-Miers. Opinion by Justice Whittington

MEMORANDUM OPINION

Relator Guillermo Ramos filed a petition for writ of mandamus challenging the failure of respondent, the Farmers Branch City Secretary, to present a referendum petition regarding Ordinance 2892 to the Farmers Branch City Council. Respondent has filed a response asserting the petition is moot because the referendum petition has been presented to the City Council in accordance with article 11 of the City Charter and chapter 277 of the Texas Election Code. We agree the respondent's presentation of the referendum petition to the City Council renders this original mandamus proceeding moot.

Accordingly, we dismiss the petition for writ of mandamus.
