On Appeal from the 402nd Judicial District Court

Wood County, Texas

Trial Court No. 2010-210

Before Morriss, C.J., Carter and Moseley, JJ.

Memorandum Opinion by Chief Justice Morriss

MEMORANDUM OPINION

Richard Jay Poe, appellant, filed his notice of appeal March 19, 2012.

The clerk's record was filed May 15, 2012, and the reporter's record was filed May 16, 2012, making the record complete. Poe's brief was therefore due June 15, 2012. When neither a brief nor a motion to extend time for filing the same had been filed by July 17, we contacted Poe's counsel by letter and informed him that, if a brief had not been filed by August 1, 2012, the appeal would be subject to dismissal for want of prosecution. See TEX. R. APP. P. 42.3(b), (c).

We have received no communication from Poe's counsel. Pursuant to Rule 42.3(b) of the Texas Rules of Appellate Procedure, we dismiss this appeal for want of prosecution. TEX. R. APP. P. 42.3(b).

Josh R. Morriss, III

Chief Justice
