Opinion

No. 05-09-00991-CV

Opinion issued August 25, 2009.

Original Proceeding from the 134th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 08-03278.

Before Justices BRIDGES, RICHTER, and LANG.

MEMORANDUM OPINION

Relators contends the trial judge abused his discretion by denying their motion to dismiss the underlying case for lack of subject matter jurisdiction. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relators have not shown they are entitled to the relief requested. See Tex. R. App. P. 52.8(a); In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). Accordingly, we DENY relator's petition for writ of mandamus.
