Before the Court are relator's January 13, 2023 petition for writ of mandamus and motion for stay of trial court proceedings. In its petition, relator challenges a January 6, 2023 order denying relator's motion to transfer venue and denying relator's plea in abatement. In the motion for stay, relator asks this Court to stay all proceedings in trial court pending resolution of its petition, including the requirements of a December 30, 2022 Temporary Restraining Order.
To the extent relator's motion requests this Court to stay any requirements of the December 30, 2022 Temporary Restraining Order that this Court has already stayed by virtue of our Order dated January 6, 2023, in relator's related original proceeding, Case No. 05-23-00012-CV, we DENY relator's motion. Our stay in Case No. 05-23-00012-CV remains in effect until resolution of that original proceeding or until further order from the Court in that proceeding.
Except as otherwise expressly denied, we GRANT relator's motion for stay and STAY all proceedings in the trial court pending resolution of relator's petition in this original proceeding. This stay shall remain in effect until resolution of this original proceeding or until further order of the Court.
We request a response, if any, to relator's petition from real party in interest and respondent by February 20, 2023.
