No. 05-08-00383-CV

Opinion issued March 31, 2008.

Original Proceeding from the 204th Judicial District Court, Dallas County, Texas, Trial Court Cause No. WX07-90062-Q.

Before Justices WHITTINGTON, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator contends the trial court violated a ministerial duty by not ruling on his application for writ of habeas corpus filed pursuant to article 11.072 of the Texas Code of Criminal Procedure. Relator's petition is deficient and he has not provided a record. Therefore, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.3, 52.7 and 52.8(a). Accordingly, we DENY relator's petition for writ of mandamus.
