IN RE THE MATTER OF BONNIE ELIZABETH PARKER

On Appeal from the County Court at Law No. 2 Dallas County, Texas Trial Court Cause No. CC-22-02516-B

Before Justices Partida-Kipness, Nowell, and Miskel

ORDER

EMILY MISKEL JUSTICE

Before the Court is appellant Crown Hill Memorial Park & Mausoleum, Inc.'s July 8, 2024 emergency motion to stay enforcement of judgment pending appeal. Suspension of enforcement of a judgment pending appeal is an issue to resolve in the first instance in the trial court. See Tex. R. App. P. 24. This Court may review a trial court's ruling on such an issue, but here there is no ruling to review. See Tex. R. App. P. 24.4.

Appellant contends that it filed a motion to stay enforcement in the trial court but has been unable, after numerous attempts, to secure a hearing on the motion. This assertion is unsupported and lacks adequate detail. Further, appellant does not complain about the trial court's failure to rule and does not seek an order from this Court compelling the trial court to do so. See, e.g., In re Torres, No. 05-22-00715-CV, 2022 WL 17485033, at *3 (Tex. App.-Dallas Dec. 7, 2022, orig. proceeding) (mem. op.).

Accordingly, we DENY the motion.
