Appeal from the 65 District Court of El Paso County, Texas (TC# 13,01271) ORDER
On September 29, 2015, the Court granted Appellant's request for a fourth extension of time to file the brief and extended the due date for the brief to October 26, 2015. The order specifically stated that the Court would not consider any further extension motions. Despite our order, Appellant has filed a fifth motion for extension of time requesting twenty five days in which to prepare and file the brief. The Court has determined it will be necessary for the trial court to conduct a hearing.
It is therefore ORDERED that the trial court conduct a hearing to determine whether appellant desires to prosecute his appeal, whether the appellant has been deprived of effective assistance of counsel, and to make appropriate findings and recommendations. The trial judge shall take such measures as may be necessary to assure effective assistance of counsel, which may include appointment of new counsel and forward its findings to the District Clerk of El Paso County, Texas on or before November 17, 2015. The District Clerk shall prepare and forward a supplemental clerk's record containing the trial court's findings and forward the same to this Court on or before November 27, 2015. Further, the trial court's reporter shall prepare, certify, and file the record of the trial court proceedings with this Court on or before November 27, 2015.
