IN RE OVERHEAD DOOR COMPANY OF SOUTH TEXAS, L.L.C.

On Petition for Writ of Mandamus.

Before Chief Justice Contreras and Justices Benavides and Longoria

ORDER

PER CURIAM

Relator Overhead Door Company of South Texas, L.L.C. filed a petition for writ of mandamus asserting that the trial court abused its discretion by denying its motion for leave to designate a responsible third party. See generally Tex. Civ. Prac. & Rem. Code Ann. § 33.004. Relator also filed a motion to stay the trial court proceedings. By previous order, this Court directed relator's motion to stay to be carried with the case. However, relator has now filed a reply brief in which it reiterates its request for a stay given the approaching trial date of August 28, 2023.

The Court, having examined and fully considered the motion to stay, is of the opinion that it should be granted. See Tex. R. App. P. 52.10. Accordingly, we grant relator's motion to stay, and we stay the trial of this case pending the resolution of this original proceeding.
