IN RE NORTH HOUSTON POLE LINE, L.P. AND GERARDO PINA, Relators

Original Proceeding on Petition for Writ of Mandamus.

Panel consists of Landau, Countiss, and Guerra, Justices.

MEMORANDUM OPINION

PER CURIAM

Relators, North Houston Pole Line, L.P. and Gerardo Pina, have filed a petition for a writ of mandamus, challenging the trial court's May 1, 2024 order partially granting and partially denying their motion to compel the deposition of non-party Townsen Memorial Hospital ("Townsen") and the production of documents by Townsen concerning its billing rates and charges.

The underlying case is Jose Reyes v. North Houston Pole Line, L.P. and Gerardo Pina, Cause No. 2020-20144, in the 333rd District Court of Harris County, Texas, the Honorable Brittanye Morris presiding.

Relators have now filed an unopposed motion to dismiss their petition for writ of mandamus, stating that "the parties [have] reached a final settlement agreement . . ., rendering the issues raised in [r]elators' [p]etition for [w]rit of [m]andamus[] moot." See Tex. R. App. P. 52.8(a).

Accordingly, we grant relators' motion and dismiss the petition for writ of mandamus. We dismiss any other pending motions as moot.
