MEMORANDUM OPINION
On October 22, 2008, appellant Gerald Dean Wright, Jr., filed a notice of appeal in this case. On October 22, 2008, we notified appellant that the $175 filing fee was due and that if appellant failed to pay the fee within ten days, the appeal would be dismissed. To date, appellant has not paid the filing fee or otherwise communicated with the Court regarding this appeal.
Accordingly, we DISMISS this appeal. See Tex. R. App. P. 5, 42.3(c).
