In light of the representations made in the September 28, 2022, declaration of Michael Hersek, filed as an exhibit in support of the Habeas Corpus Resource Center's September 29, 2022, "Motion to Transfer Morgan Petition to the Riverside Superior Court or Alternatively for the Appointment of HCRC as Counsel for Petitioner; Request for an Order Affirming that an Amended Petition Filed Within Three Years of Appointment of Counsel Will Be Considered Timely Filed" (see Hersek Decl. at ¶¶ 8-10), the petition for writ of habeas corpus filed on November 13, 2014, and pending in this court on October 25, 2017, is transferred to the Superior Court of California, County of Riverside, pursuant to Penal Code section 1509, subdivision (g). The Habeas Corpus Resource Center's alternative request for appointment by this court as counsel for petitioner and its request for an order "affirming that an amended petition filed within three years of appointment of counsel will be considered timely filed" are denied.
