Pursuant to Gov.Jud.R. II(5)(D)(1), the five-judge commission appointed to consider the above-cited matter convened by telephone conference on August 15, 2012.
On August 8, 2012, the respondent filed a motion for sanctions. On August 10, 2012, the complainant filed a memorandum in opposition to the respondent's motion.
On August 10, 2012, the complainant, by and through counsel, filed a motion to supplement the record, or alternatively, to remand to the hearing panel for the receipt of additional evidence of the respondent's continuing violations of Canon 4. On August 14, 2012, the respondent filed a memorandum contra to the complainant's motion.
Upon consideration thereof,
It is hereby ordered by the five-judge commission that the respondent's motion for sanctions and the complainant's motion to supplement the record be, and hereby are, denied.
It is further ordered that the complainant shall file on or before August 22, 2012, an itemized affidavit of her attorney expenses incurred in this matter through August 13, 2012.
