No. 05-07-01031-CV

Opinion Filed September 20, 2007.

On Appeal from the 254th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 89-6857-R.

Before Chief Justice Thomas and Justices Bridges and FitzGerald.

MEMORANDUM OPINION

On August 6, 2007, Deborah Williams filed a notice of appeal in this case. On August 9, 2007, we notified Ms. Williams by letter that the $125 filing fee was due. On August 13, 2007, Michael D. De Spain filed a notice of appeal in this case. On August 16, 2007, we notified Mr. De Spain by letter that the $125 filing fee was due. We gave each appellant ten days to pay the filing fee, and we warned appellants that if they failed to comply with our directives within the time allowed, the appeal was subject to dismissal without further notice. Nevertheless, to date, neither appellant has paid the filing fee or otherwise communicated with the Court regarding the appeal.

Accordingly, on the Court's own motion, we DISMISS the appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
