Respondent-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from a decision of the Family Court, Jefferson County, entered August 4, 2021,

Now, upon reading and filing the papers with respect to the application, and due deliberation having been had thereon, It is hereby ORDERED that the appeal is dismissed on the ground that no appeal lies from a decision (see Matter of Hankinson v Steele, 195 A.D.3d 1380, 1380-1381 [4th Dept 2021]; Kuhn v Kuhn, 129 A.D.2d 967, 967 [4th Dept 1987]), and

It is further ORDERED that the application is dismissed.
